These terms are a plain-language agreement between you and Instadata ("we", "us") covering the Instadata website and API. By creating an account or calling the API you agree to them. If you use Instadata on behalf of a company, you agree for that company.
Instadata provides programmatic access to publicly available Instagram data (profiles, posts, reels, comments, hashtags, places, Meta Ad Library ads, branded-content partnerships and transcripts) through a credit-metered REST API and an MCP server. We access only data that is publicly reachable without logging in; private accounts and logged-in-only content are out of scope by design.
You need an account and an API key to call the API. Keep keys secret; calls made with your key are your calls. You are responsible for activity under your account and must give us accurate contact information. One person or company may not create multiple accounts to accumulate free credits.
Usage is billed in credits. Each endpoint's price is shown on its page and charged per unit returned, subject to any per-call minimum shown there; transcripts are additionally charged per started minute of video. Calls that fail with an error are not charged. Empty results are free up to 25 a day per account; after that an empty result costs one credit. Stored responses cost the same as live ones. Subscription credits are granted each billing period and unused credits roll over; credits, including top-ups, do not expire while the account is open. Prices are listed on the pricing page and may change with notice, never retroactively for a period already paid for.
You can cancel at any time from the dashboard; cancellation stops future renewals and remaining credits stay usable while the account is open. Because credits are consumed on use, payments are generally non-refundable once a period has started, except where the service materially failed to work or where law requires otherwise. Email us and we will be reasonable.
You agree not to use the API to:
You are responsible for how you use the data you retrieve, including compliance with Instagram's terms as they apply to you and with intellectual-property and privacy rights in downloaded media.
Responses are generated from publicly available sources at request time or from storage; storage behaviour is documented and visible in response headers. We do not guarantee that any piece of content is available, current or accurate. Transcripts and summaries are machine output and may contain errors. We honour removal requests for stored content; see contact.
We aim for high availability, but the service is provided "as is" and "as available", without warranties of any kind. Instagram changes without notice, and individual capabilities can degrade or be withdrawn when what they depend on is removed. Where a capability is known to be limited, its page says so. We may change or discontinue features with reasonable notice where practical.
To the maximum extent allowed by law, our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve months before the claim, and neither party is liable for indirect, incidental or consequential damages. Nothing here limits liability that cannot lawfully be limited.
You can stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms, create risk for the service or other users, or go unpaid; where practical we warn first. Sections that by their nature should survive (billing owed, liability limits, disputes) survive termination.

When we change these terms materially we update the date above and notify active customers by email before the change takes effect. Continued use after the effective date means you accept the updated terms.
